Welcome to Bunk ("Bunk", "we", "us", or "our"), a brand owned and operated by Terraluxe Concepts Private Limited, a company incorporated under the Companies Act, 2013 with its registered office in Bengaluru, Karnataka, India.

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Terraluxe Concepts Private Limited governing your access to and use of our website, mobile application, and any related services (collectively, the "Platform").

By accessing or using our Platform, placing an order, or creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Platform immediately.

Eligibility: You must be at least 18 years of age to use our Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

• "Platform" means the Bunk website, mobile application, and all associated digital properties operated by Terraluxe Concepts Private Limited.
• "Products" means all products listed for sale on the Platform.
• "Order" means a purchase request submitted by you for one or more Products through the Platform.
• "User Content" means any content, text, images, reviews, or other material you submit or upload to the Platform.
• "Intellectual Property" means all trademarks, logos, designs, trade names, copyrights, and other proprietary rights belonging to Terraluxe Concepts Private Limited and/or the Bunk brand.

3.1 Permitted Use

You may access and use the Platform solely for lawful personal, non-commercial purposes in accordance with these Terms. You agree to use the Platform in a manner consistent with all applicable laws and regulations in India, including the Information Technology Act, 2000, and the rules thereunder.

3.2 Prohibited Conduct

You must not:

• Use the Platform for any unlawful, fraudulent, or malicious purpose.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to the Platform, its servers, or any connected systems.
• Use any automated tool, bot, spider, or scraper to access or extract data from the Platform.
• Upload or transmit viruses, malware, or any other harmful code.
• Reproduce, duplicate, copy, sell, or resell any portion of the Platform or its content without our express written permission.
• Post, upload, or share any content that is unlawful, defamatory, obscene, harassing, threatening, or otherwise objectionable.
• Circumvent or attempt to circumvent any technical or security measures implemented on the Platform.

To access certain features of the Platform, you may be required to create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately at support@bunkit.co.in of any unauthorized use of your account.

You are solely responsible for all activity occurring under your account. We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

5.1 Product Information

We make reasonable efforts to ensure that product descriptions, images, colours, dimensions, and other details are accurate. However, we do not warrant that all product information is error-free or complete. Minor variations in colour and texture may occur due to screen display settings or manufacturing processes.

5.2 Pricing

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless otherwise indicated. Prices are subject to change without prior notice. In the event of a pricing error, we reserve the right to cancel or reject any Order placed at the incorrect price, with a full refund if payment has been made.

5.3 Availability

All Products are subject to availability. We reserve the right to limit quantities, discontinue Products, or restrict access to the Platform at any time without liability.

6.1 Order Placement

Placing an Order on the Platform constitutes an offer to purchase the selected Product(s) at the stated price. An Order is confirmed only upon receipt of our order confirmation email. We reserve the right to decline any Order at our sole discretion.

6.2 Payment

We accept payment via the methods available on the Platform at the time of checkout, which may include credit/debit cards, UPI, net banking, and select digital wallets. All transactions are processed through secure, third-party payment gateways. We do not store your complete payment card details on our servers.

6.3 GST & Invoicing

A GST-compliant tax invoice will be issued for each successful Order and made available in your account or sent to your registered email address.

We currently ship within India. Estimated delivery timelines are provided at checkout and are indicative only. Delivery timelines may vary due to factors including but not limited to:

• Geographic location and accessibility.
• Third-party logistics partner delays.
• Force majeure events such as natural disasters, strikes, or government restrictions.

Risk of loss and title for Products pass to you upon dispatch by us. We are not liable for delays or non-delivery caused by inaccurate or incomplete shipping information provided by you. Shipping charges, if applicable, will be displayed at checkout.

8.1 No Return or Refund Policy

All sales made on the Platform are final. Products once purchased are not eligible for return or refund, except in the limited circumstances expressly set out in Section 8.2 below. We encourage you to review product descriptions and specifications carefully before placing an Order.

8.2 Dead on Arrival (DOA) Policy

In the event that you receive a product that is defective or non-functional upon delivery ("Dead on Arrival" or "DOA"), Bunk will arrange for a replacement, subject to the following conditions:

• A support ticket must be raised at support@bunkit.co.in within 7 calendar days of the date of delivery. Requests raised after this period will not be eligible for DOA replacement and will be governed by the applicable standard warranty terms.
• Upon receipt of the support ticket, a Bunk technician will assess and verify the reported defect. You may be required to provide photographs, videos, or other evidence of the defect to facilitate this review.
• If the defect is confirmed by the Bunk technician, a replacement unit of the same product (subject to availability) will be dispatched to your delivery address at no additional cost. The defective product will be collected from you at the time of or following delivery of the replacement unit.
• DOA claims are valid only for manufacturing or functional defects present at the time of delivery. Damage caused by misuse, mishandling, unauthorised modification, or normal wear and tear does not qualify for DOA replacement.

8.3 Standard Warranty

For any product issues arising after the 7-day DOA window, the standard warranty terms applicable to the specific product will apply. Details of the warranty coverage, duration, and claim process are provided on the Platform or available upon request at support@bunkit.co.in.

8.4 Consumer Protection

These provisions are in addition to, and do not limit, your statutory rights under the Consumer Protection Act, 2019 and applicable consumer protection regulations.

All content on the Platform including but not limited to the Bunk name, logo, taglines, designs, graphics, photographs, text, software, and underlying code is the exclusive property of Terraluxe Concepts Private Limited and is protected under applicable intellectual property laws, including the Trade Marks Act, 1999 and the Copyright Act, 1957.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes only. Nothing in these Terms transfers any intellectual property rights to you. Unauthorised use, reproduction, modification, or distribution of any content from the Platform is strictly prohibited and may result in legal action.

By submitting any content to the Platform (including product reviews, comments, photographs, or social media tags), you grant Terraluxe Concepts Private Limited a worldwide, royalty-free, non-exclusive, sub-licensable licence to use, reproduce, modify, distribute, and display such content in connection with our business and marketing activities.

You represent and warrant that your User Content does not infringe any third-party rights and complies with all applicable laws. We reserve the right to remove any User Content at our sole discretion without notice.

THE PLATFORM AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

To the fullest extent permitted by applicable law, Terraluxe Concepts Private Limited and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform or Products.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the total amount paid by you for the specific Order giving rise to the claim.

You agree to indemnify, defend, and hold harmless Terraluxe Concepts Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights.

The Platform may contain links to third-party websites or services. These links are provided for your convenience only. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites. Your use of third-party websites is governed by their respective terms and conditions.

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

15.2 Dispute Resolution

In the event of any dispute or claim arising out of or in connection with these Terms, the parties shall first attempt to resolve the matter through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice by either party, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, Karnataka, and proceedings shall be conducted in English.

15.3 Jurisdiction

Subject to the arbitration clause above, the courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any matter arising out of or relating to these Terms.

We reserve the right to modify these Terms at any time. The revised Terms will be posted on the Platform with an updated effective date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, without liability to you. Upon termination, all licences granted to you under these Terms will immediately cease.

• Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Terraluxe Concepts Private Limited regarding your use of the Platform.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver: Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

1.1 Information You Provide

We collect personal information that you voluntarily provide to us, including:

• Identity Data: Full name, date of birth, gender.
• Contact Data: Email address, mobile number, shipping and billing address.
• Account Data: Username, password (encrypted), account preferences.
• Transaction Data: Order history, payment method type (not full card details), invoice records.
• Communication Data: Messages, feedback, support requests, and reviews submitted by you.
• User Content: Product reviews, photographs, and other content you post on the Platform.

1.2 Information Collected Automatically

When you visit our Platform, we automatically collect certain technical data through cookies and similar technologies, including:

• Pages visited, time spent on pages, links clicked, referring URLs.

• To process and fulfil Orders, including payment processing and delivery.

• To personalise your shopping experience and improve our product recommendations.

We process your personal data on the following legal bases: (a) performance of a contract; (b) your consent; (c) compliance with a legal obligation; and (d) our legitimate interests, provided such interests are not overridden by your fundamental rights.

4.1 Service Providers

4.2 Legal & Regulatory Requirements

We may disclose your personal data to government authorities, law enforcement agencies, or other parties if required by law, court order, or regulatory mandate, or if we believe such disclosure is necessary to protect the rights, property, or safety of Terraluxe Concepts Private Limited, our users, or the public.

4.3 Business Transfers

In the event of a merger, acquisition, restructuring, or sale of all or a portion of our business assets, your personal data may be transferred to the acquiring entity, subject to equivalent privacy protections.

We retain your personal data for as long as necessary to fulfil the purposes set out in this Privacy Policy, or as required by applicable law. Specifically:

• Account data is retained for the duration of your account and for 3 years after account deletion, unless a longer retention period is required by law.

The Platform is not directed at children under the age of 18. We do not knowingly collect personal data from minors. If we become aware that we have inadvertently collected personal data from a child under 18 without parental consent, we will take steps to delete such data promptly. If you believe we have collected data from a minor, please contact us immediately at support@bunkit.co.in.

Your personal data may be transferred to and processed in countries outside India, including in jurisdictions where our service providers operate. Where such transfers occur, we ensure that appropriate safeguards are in place consistent with applicable Indian data protection law, including contractual protections with the relevant service providers.

If you access the Platform through social media login features or engage with our content on third-party social media platforms (such as Instagram, Facebook, or YouTube), please note that those platforms have their own privacy policies. We encourage you to review those policies. We are not responsible for the privacy practices of third-party platforms.

With your consent, we may send you promotional emails, SMS notifications, and WhatsApp messages about new Products, offers, and events. You may opt out of marketing communications at any time by:

• Clicking the 'Unsubscribe' link in any marketing email.
• Sending a request to support@bunkit.co.in.
• Updating your communication preferences in your account settings.

Opting out of marketing communications will not affect transactional communications related to your Orders or account.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. We will notify you of material changes by posting the revised policy on the Platform with an updated effective date, and, where required by law, by providing direct notice via email. Your continued use of the Platform after the effective date of the revised policy constitutes your acceptance.
